Session Objectives:
By the end of this session participants will be able to…
• Have an understanding of the mediation process and the advantages it offers over continued litigation in terms of process, costs savings and satisfaction to litigants.
• Understand differences between mediation, arbitration and early neutral evaluation.
• Understand benefits to the agency and injured worker of early resolution including opportunities for global settlements of complex cases often with crossover issues such as employment law that frequently occur in workers' comp cases.
• Understand options for creative resolutions that are not available in traditional judicial resolution of case
• Understand selection process for mediator; what makes a case appropriate for mediation; preparation for a successful mediation; costs of mediation; what goes into a successful mediation from perspective all participants
Session Summary:
More and more complex workers' compensation cases are being resolved through mediation. All studies confirm that cases resolved through mediation result in high degrees of satisfaction on both sides with substantial cost savings and earlier resolution than fully litigated cases. Two highly experienced mediators with proven track records of successfully settling cases will present a step-by-step guide to the mediation process and will offer suggestions as to how participants can utilize mediation for resolution of challenging cases.
